Refugee and Asylum Law: Pakistan Obligations Towards Afghan Refugees under International Law

Pakistan has given shelter to millions of people from Afghanistan for more than four decades. Still, it never acceded to the 1951 Refugee Convention. This study checks, what Pakistan must do for these refugees under treaties. It deals with important rules from treaties, the common law such as the no-return idea and guidelines but to make it easier I combined law review, example of other countries. The beginning includes some background information about refugee movement between Afghanistan and Pakistan. It asks main questions. Then the work details Pakistan's jobs for afghan refugees, common norms and soft rules. Those mix in with laws of Pakistan itself. A part of it talks about the rulings and policies of Pakistan. It shows where they are in excess of or below world standards. Looks from Iran, Turkey and Germany spot light diverse ways to deal with the refugee issues There are stories from after 2001 and 2021 showcasing Pakistan its actions on big group coming and going back. Numbers help there. Findings include that there are no treaties, Pakistan is following that include no force return etc. It sometimes does so quietly. But there are gaps in the local law that create problems of protection. Suggested new laws and deals with the world. Call for additional assistance from others to keep the refugees safe.
