خنثیٰ اور ٹرانسجینڈر کے مسائل: اسلامی فقہ، پاکستانی و بین الاقوامی قوانین و سائنسی تحقیقات کی روشنی میں ایک تجزیاتی مطالعہ

Abstract

 یہ تحقیقی مقالہ پاکستان میں 2018ء کے "ٹرانسجینڈر ایکٹ" اور اس کے دینی، سماجی، قانونی اور سائنسی مضمرات کا تفصیلی مطالعہ ہے۔ اس مضمون میں ٹرانسجینڈر کی پانچ اقسام کا فقہی تجزیہ پیش کیا گیا ہے جنہیں کلاسیکی فقہ میں "خنثیٰ" اور اس کی ذیلی اقسام کے طور پر بیان کیا گیا ہے۔ مضمون میں ان افراد کے حقوق، وراثتی مسائل، معاشرتی پہلو اور فقہی اصولوں کا بیان کیا گیا ہے، نیز پاکستان کے موجودہ قانونی ڈھانچے اور بین الاقوامی قوانین کا تقابلی جائزہ لیا گیا ہے۔

سائنسی تحقیقات کی روشنی میں intersex (خنثیٰ) اور transgender کے درمیان فرق کو بھی واضح کیا گیا ہے۔ تحقیق کا نتیجہ یہ ہے کہ اسلامی فقہ "خنثیٰ غیر مشکل" اور "خنثیٰ مشکل" کے مسائل کے حل کے لیے واضح اصول فراہم کرتی ہے، جبکہ جدید قانون سازی بعض پہلوؤں میں مذہبی و سماجی اقدار سے متصادم نظر آتی ہے۔

This research article provides a detailed study of Pakistan’s 2018 “Transgender Persons (Protection of Rights) Act” and its religious, social, legal, and scientific implications. It analyzes the five categories of transgender identities discussed in classical Islamic jurisprudence under the term khunthā (intersex) and its subtypes. The article explores issues of inheritance, rights, and social integration while comparing the Islamic legal framework with Pakistan’s legislative context and international law. In light of scientific findings, the distinction between intersex and transgender identities is clarified. The study concludes that Islamic jurisprudence offers clear principles for resolving the issues of khunthā ghayr mushkil and khunthā mushkil, whereas modern legislation sometimes conflicts with established religious and cultural norms.
